1. Introduction
These Terms and Conditions govern the use of services provided by Fogel Fencing Limited (“the Company”, “we”, “us”, “our”), based in Tunbridge Wells, United Kingdom. By engaging our services, you (“the Client”) agree to be bound by these Terms. Please read them carefully before entering into any agreement.
2. Scope of Services
Fogel Fencing Limited provides fencing supply, installation, maintenance, and temporary hire services. Our services may include but are not limited to:
- Residential fencing installation and repair.
- Commercial and security fencing.
- Agricultural and boundary solutions.
- Temporary and event fencing hire and installation.
3. Quotations and Pricing
3.1 All quotations are valid for 30 days from the date of issue, unless stated otherwise.
3.2 Prices are exclusive of VAT unless expressly stated.
3.3 The Company reserves the right to revise a quotation where material costs or labour requirements change due to circumstances beyond our control.
4. Payment Terms
4.1 A deposit may be required prior to commencement of work.
4.2 Full payment must be made within 14 days of invoice unless otherwise agreed in writing.
4.3 Failure to pay within the stated terms may result in suspension of services and additional charges for late payment recovery.
5. Delivery and Installation
5.1 Installation dates are estimated and subject to weather conditions, site readiness, and material availability.
5.2 The Client must ensure clear and safe access to the work area at all times.
5.3 Any delays caused by the Client may result in additional charges.
5.4 Temporary fencing hires are provided on the basis that all items are returned in good condition, subject to fair wear and tear.
6. Client Responsibilities
6.1 The Client must obtain any necessary planning permissions, permits, or consents prior to installation.
6.2 The Client is responsible for identifying underground utilities or obstructions. The Company accepts no liability for damage to concealed services unless previously disclosed in writing.
6.3 For hired fencing, the Client is responsible for safeguarding equipment against loss, theft, or damage during the hire period.
7. Health & Safety
7.1 The Company adheres to all relevant UK health and safety regulations.
7.2 Clients must ensure the work environment is safe and free of hazards.
8. Warranties and Guarantees
8.1 New fencing installations are covered by a workmanship guarantee of 12 months unless otherwise specified.
8.2 Manufacturer warranties apply to supplied materials.
8.3 Guarantees do not cover damage caused by accidents, misuse, extreme weather, or lack of maintenance.
9. Limitation of Liability
9.1 The Company shall not be liable for indirect, incidental, or consequential loss or damage.
9.2 Liability is limited to the total value of the contract.
10. Cancellations and Termination
10.1 Cancellations must be made in writing no later than 7 days before scheduled work.
10.2 Deposits are non-refundable once materials have been ordered or work has commenced.
10.3 The Company may terminate the agreement if the Client breaches these Terms.
11. Data Protection & Privacy
11.1 The Company may collect and process personal data in line with the UK GDPR and Data Protection Act 2018.
11.2 Personal data will only be used to fulfil contractual obligations and will not be shared with third parties without consent, except where required by law.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
